TERMS AND CONDITIONS
By booking with St. Mary’s Lodging you (guest) acknowledge and agree that you are subject to the following terms and conditions. Please read these terms carefully, as they contain important information about limitations of liability and resolution of disputes.
Upon requesting a reservation with St. Mary’s Lodging, your request will be reviewed by a St. Mary’s Lodging booking agent. You hereby authorize St. Mary’s Lodging to contact you via any form of communication provided including phone calls, emails and text messaging during the booking process as well as throughout and following the rental arrangement. A reservation is not confirmed until St. Mary’s lodging determines, in its sole discretion, whether it will enter into a rental arrangement with the requesting party. Upon accepting a reservation request, a guest’s reservation is bound by these terms and conditions. The terms constitute a legally binding agreement between you and St. Mary’s Lodging. You are not authorized to book with St. Mary’s Lodging unless you are at least 18 years of age and able to enter into legally binding contracts. St. Mary’s Lodging does not knowingly collect the information of anyone under the age of 18.
Terms applicable to all bookings
Reservation requests with St. Mary’s Lodging are submitted by following the respective booking process. All applicable fees, including the rental fee and any additional fees and any applicable taxes (collectively, “Total Fees”) will be presented to you at the time of requesting a reservation. You agree to pay the Total Fees for any reservation requested.
Upon receipt of a reservation confirmation from St. Mary’s Lodging, a legally binding and non-transferable agreement is formed between you and St. Mary’s Lodging under these terms and conditions and any rules and restrictions specified for each listing. St. Mary’s Lodging will collect the Total Fees upon confirmation of the reservation. Failure to pay the entire Total Fees may result in your reservation being cancelled. All properties are subject to a cancellation fee of 50% of the Total Fees collected if cancellation is made at least two weeks prior to the reservation. If cancellation is made within two weeks of the reservation, no refund of the Total Fees will be made.
As the Booking Party, you and your guests agree to follow the rules and regulations set by St. Mary’s Lodging for each accommodation. If you are booking for an additional guest who is a minor, you represent and warrant that you are legally authorized to act on behalf of the minor and shall be responsible and liable for all actions of any minor. Minors may only use the accommodations of St. Mary’s Lodging if accompanied by an adult who is responsible for them.
You understand that a confirmed booking of an accommodation is a limited license granted to you by St. Mary’s Lodging to enter, occupy and use the accommodation for the duration of your stay, during which time St. Mary’s Lodging retains the right to re-enter the accommodation, in accordance with your agreement with St. Mary’s Lodging.
You agree to leave the accommodation no later than the checkout time that St. Mary’s Lodging specifies in the listing or such other time as mutually agreed upon between you and St. Mary’s Lodging. If you stay past the agreed upon checkout time without St. Mary’s Lodging’s consent, you no longer have a license to stay in that accommodation and St. Mary’s Lodging is entitled to make you leave in a manner consistent with applicable law. In addition, you agree to pay, if requested by St. Mary’s Lodging, for each twenty-four (24) hour period (or any portion thereof) that you overstay, an additional nightly fee of up to two (2) times the average nightly Listing Fee originally paid by you to cover the inconvenience suffered by St. Mary’s Lodging, plus all applicable fees and any legal expenses incurred by St. Mary’s Lodging to remove you from the premises. Overstay fees for late checkouts on the checkout date that do not impact upcoming bookings may be limited to the additional costs incurred by St. Mary’s Lodging as a result of such overstay. If a credit card is used to pay the Total Fees, you hereby authorize St. Mary’s Lodging to charge any overstay fees to this credit card.
Damage to Accommodations
As a guest, you are responsible for leaving the accommodation (including any personal or other property located at the accommodation) in the condition it was in when you arrive. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or otherwise provide access to, the accommodation, excluding St. Mary’s Lodging.
If St. Mary’s Lodging claims and provides evidence that you as a guest have damaged an accommodation or any personal or other property at an accommodation, St. Mary’s Lodging will seek payment from you. St. Mary’s Lodging will determine in its sole discretion that you are responsible for the damage and will collect any such sums from you. St. Mary’s Lodging also reserves the right to otherwise collect payment from you and pursue any remedies available to St. Mary’s Lodging.
St. Mary’s Lodging does not charge a specific cleaning fee for use of its accommodations so long as the accommodations are reasonably used. However, if it is determined, in St. Mary’s Lodging’s sole discretion, that the accommodations will require additional cleaning to restore the property to a rentable condition, then you will be responsible for this additional cleaning. All St. Mary’s Lodging’s accommodations are non-smoking and pet-free. Any smoking inside the property by you or any guests or bringing pets upon the accommodations will result in a $250 cleaning fee assessed to you. If a credit card is used to pay the Total Fees, you hereby authorize St. Mary’s Lodging to charge any damage fees or cleaning fees to this credit card.
Applicable Law and Jurisdiction
These terms and conditions will be interpreted in accordance with the laws of the State of Kansas and with the appropriate jurisdiction and venue as the District Court of Pottawatomie County.
